UAE Announces Refund for Tax Service Fees

What Businesses Need to Know

Starting August 1, 2024, businesses in the UAE can get refunds for certain tax service fees. The Federal Tax Authority (FTA) has introduced a new policy that could put money back into your company’s pocket if you’ve paid for tax clarification services. This article breaks down the details of the new refund policy and how it might benefit you.

What’s the New Refund Policy?

From August 1, 2024, the FTA will refund fees for “private clarification” if certain conditions are met. This service, which started requiring payment from June 1, 2023, allowed businesses to request further clarification on tax matters. If the FTA doesn’t respond to your request or only answers some of your questions, you might qualify for a refund.

Once you requested clarification on multiple taxes and did not receive any, you will get a full refund. If the FTA only answered some of your questions, you will receive a partial refund. The refund amount will be based on the difference between the fee for multiple taxes and the fee for a single tax.

When Can You Get a Refund?

The new policy outlines specific situations where you can get a refund:

Request Withdrawn

If you withdraw your clarification request within two business days, you can get your fee back.

Ineligible Requests

If someone who is not registered for Corporate Tax made the request and it didn’t concern tax registration, they can get a refund.

Tax Audit

If you submit your request while your company is undergoing an audit, you can get a refund.

Procedure-Related Requests

If your request was about procedures following a decision from the Authority, you can get a refund.

Duplicate Requests

If you submitted a duplicate request on the same issue and the Authority is already handling it, you’ll receive a refund.

Legislative Review

If you request clarification on a topic that the authorities are reviewing for changes in tax legislation, you can get a refund.

Why This Matters

This new policy is a win for businesses. It ensures that you’re not stuck paying for services that don’t provide the answers you need. By simplifying the process and offering refunds, the FTA is making it easier for companies to get the clarity they need without extra costs.

How to Claim Your Tax Refund

To make the most of this refund policy, review any past requests for tax clarification. Check if any of them fit the conditions for a refund. Keep all records of payments and communications to make the refund process as smooth as possible.

The UAE’s new tax service fee refund policy is a step toward more transparent and fair tax practices. By offering refunds in specific situations, the FTA helps ensure that businesses aren’t paying for services that don’t deliver. Stay informed and check your eligibility to make sure you can take advantage of this opportunity.
