Can Your Boss Reject Your Annual Leave Request in the UAE?

Planning a vacation can be exciting, but employees in the UAE might face disappointment if their leave request gets denied, even if they submit it well in advance. Here’s what you need to know about how and when an employer can legally reject your annual leave request, and what you can do to protect yourself.

Understanding UAE Labor Law on Annual Leave

In the UAE, the labor law allows employers significant control over when employees can take their annual leave. According to Article 29(4) of Federal Decree-Law No. 33 of 2021, employers can set the dates for leave or rotate leave among employees to keep business operations running smoothly. So, even if you apply for leave two months ahead, your employer might still reject it if it doesn’t fit with the company’s needs.

What If You’ve Already Made Travel Arrangements?

It’s frustrating to have your leave request denied after you’ve booked flights and made travel plans. While this situation is tough, UAE law generally supports the employer’s right to prioritize business needs over personal plans. If your employer approves your leave in writing and then revokes it later, they may need to compensate you for any financial losses, such as non-refundable flight tickets. However, since the law doesn’t clearly outline this remedy, you should secure written approval before making any travel arrangements.

Steps to Protect Your Annual Leave

  • Get Written Approval: Always secure written approval for your leave before booking any travel plans. This can help protect you if your leave gets denied later.
  • Plan Flexibly: Be aware that work requirements can change. Try to plan your travel with some flexibility in case your leave needs to be adjusted.
  • Communicate Early: Talk to your employer about your leave plans well in advance to avoid any last-minute surprises.

While UAE law gives employers considerable power in managing annual leave, there are steps you can take to safeguard your plans. Getting written approval and planning flexibly will help you minimize potential issues and enjoy your vacation without added stress.
